Nothing can be done about it. Only admins can retire/send to beta already approved katas, and I doubt that they have the time to decide which kata should be left as is and which ones should be removed.

Either remove the comment or change it to use #. Also, an explicit message about why it failed would be good.

You can't fork the original. You can only edit it directly, which makes testing it a bit hairy. I'd fork your favourite solution, tweak the tests there, and copy / paste that in its entirety.
