I think the way of using (braces) would be clearer!
like: "Divide a list (of at least two elements) into two non-empty parts"
Not sure what this in reference to either and it's been 4 months so I'd say this is pretty safe to mark as resolved. Then we can go ahead and approve this kata out of beta =)
No worries! And my intention wasnt to criticize. I just slightly agreed with OP, I did have to read the description twice. No big deal.

At the least the grammar is incorrect. It should be "divide a list of at least two elements INTO two non-empty parts" for clarity you could change it to "Divide a list (of at least two elements) into two non-empty parts"
Thanks for the feedback - I have changed dice to die where appropriate but left the description as it is; the intetion is for it to be wordy given that it is trying to teach.
